Part 1 – Overview, new developments mainly in the EU and UK

Technology has been evolving rapidly in recent years. Generative AI is one of the hot technologies and is being used more actively in people’s lives. While generative AI brings benefits such as improving productivity, it may give rise to antitrust/competition concerns such as creating an entry barrier for new entrants by establishing strong advantages for certain businesses who already have extensive access to data set. In addition, digital cartel issue (whether cartels committed by or via AI are a violation of antitrust/competition law?) continues to be the subject of discussion.
Governments and competition authorities around the world are discussing and trying to address antitrust/competition concerns in the digital area, including with generative AI. Last November, the Japan Fair Trade Commission (“JFTC”), in cooperation with the Secretariat of Headquarters for Digital Market Competition of the Cabinet Secretariat (“Digital Headquarters”), held the G7 Joint Competition Enforcers and Policy Makers Summit in Tokyo. In addition to competition authorities from the G7 countries, competition authorities from Australia, India, Korea and South Africa also attended.
At Part I of this seminar, we start with providing an overview of global trends, and then will introduce the current situation and new developments in the EU and UK. AI is already on the antitrust watchdog’s radar in Europe. The European Commission as well as national competition authorities within the EU have launched investigations into the impact of AI on competition. The UK’s CMA and the EC are already scrutinizing some of BigTech’s AI partnerships. The EU Artificial Intelligence Act, which is expected to be adopted by April 2024, will potentially provide another gateway for AI antitrust enforcement. We will also touch upon the new developments in Australia, including the Government’s proposed approach to regulating AI and observations on the competition regulator’s key areas of focus.
Part 2 – New developments in Japan

Developing a competitive environment in the digital sector is one of the JFTC’s area of focus. The JFTC and/or the Digital Headquarters has been conducted market surveys and published various reports, including the Report on Algorithms/AI and Competition Policy on March 31, 2021. As mentioned above, the JFTC hosted the “G7 Enforcers and Policy Makers Summit” where the competition authorities discussed priorities, challenges and approaches for competition authorities in the digital area.
We will explain about the current situation and new developments on AI and Japanese Anti-Monopoly Act.
Part 3 – AI Use for investigation and litigation

In addition to Technology Assisted Review (TAR), that has been utilized already in this industry, we would discuss about Generative AI; How it could be expected to work in future and the latest situation and outlook talked in the US. This part will be a moderated discussion session including our data scientist.
