Part 1 – Modern Technologies and AI:
What Japanese Companies Can Expect When Negotiating with Government Agencies

This presentation will cover hot topics and common themes -- focused on modern technologies and artificial intelligence -- when companies around the world are in an investigation or a litigation with the Department of Justice, the Federal Trade Commission, or any other United States government agencies. As just a few examples, we will cover complexities in investigations and litigations relating to AI, mobile devices, text messages, ephemeral messages, electronic discovery protocols, protective orders, modern technology policies, and the like. In addition, the presentation will cover written guidance from the agencies that should help Japanese and other companies know what the agencies expect companies to be doing in this arena. This will include, for example, the Department of Justice's most recent 2023 guidance on how it will evaluate corporate compliance programs concerning mobile devices, communications platforms, and ephemeral messaging.
Part 2 – Crisis & Risk Management and Digital Transformation (DX) of Japanese Companies
-- Push Forward DX as a Management Issue from the Perspective of Risk Management

Is digital transformation (DX) progressing smoothly at your company? When I was in charge of fraud investigations and compliance matters, I realized that if I had been able to promote DX and know in advance what kind of materials and data existed within the company, I would have been able to deal with them sooner before they became a big problem. I often feel that this may be the case.
As for trends among Japanese authorities, I can point to the National Tax Agency’s (“NTA”) direction to drive DX forward in tax administration. In 2021, the NTA presented its ideas on the direction that procedures and operations related to national taxation should take in the DX era, and in June 2023, the NTA released "Digital Transformation of Tax Administration - Future Vision of Tax Administration 2023”, outlining the details of the digital transformation. The theme of "improving the efficiency and sophistication of taxation and collection operations (thorough utilization of data)" is expected to have a significant impact on businesses in the future, in conjunction with the promotion of digital invoicing under the so-called "invoice system" that was launched in October 2023. I will provide my perspective on how DX promotion has become an urgent issue for Japanese companies.
