James co-leads the Emerging Technology team of BakerHostetler’s Digital Assets and Data Management group while directing the firm’s Artificial Intelligence and Information Governance engagements. His work spans litigation, transactions and regulatory enforcement while helping clients confront discovery management process issues; enterprise risk management; records and information governance; data privacy, security and bank secrecy; artificial intelligence and algorithmic transparency; technology integration issues; and related merger and acquisition, asset purchase and divestiture diligence.

Summary

In this webinar, an attorney with experience in Artificial Intelligence (“AI”) and AI’s intersection with the practice of law will introduce the topic, discuss various types of artificial intelligence, and cover various world-wide ethical considerations and enforcement issues associated with the issue.
The lecture begins with an introduction to AI and related technologies, including a definition of Machine Learning (“ML”) AI algorithms for attorney understanding, a discussion of different types of Algorithms and the Dimensionality Reduction Algorithm in particular, and various AI Paradigms.
The discussion continues with proposed international AI legal and/or ethical frameworks, with considerations of proposed legal and/or ethical frameworks applicable to AI, AI data ethics principles and examples generally, and various ethical frameworks and legislation that include the Future of Life Institute – Asilomar AI Principles; the IEEE Global Initiative on Ethics of Autonomous and Intelligent Systems; the OECD Recommendation of the Council on AI; ABA Resolution 112 on the Usage of AI; the FTC – Aiming for Truth, Fairness, and Equity proposals; and the Chinese Personal Information Protection Law.
Finally, the lecture touches on AI Regulatory Enforcement Considerations by reviewing caselaw, enforcement actions, contracting, and IP considerations related to AI, including FTC enforcement of Section 5 of the FTC Act, FCRA, and ECOA against users and developers of unfair or biased algorithms. as well as EU data protection authorities.
